Man being charged for whistling too loud

Should Robert Smith be charged for whistling? The Portland, Maine man was cited twice by the police due to whistling too loud while walking down the sidewalk on Feb. 25. Business owners complained that his whistling was disturbing the peace. Now Robert can still whistle, but he has to keep moving or he faces jail time.
The thought of a man going to jail all because he whistles too loud, is really preposterous. There are people that stand on the sidewalks and play instruments, but they don’t get the police called on them. What is the difference between and instrument being played outside, and a man whistling while he walks by? It’s still music either way. Laws like this one are a no brainer; don’t have one. Society today has been getting over sensitive and as soon as something happens that they don’t like, they run to the government to make a law for it to stop. They also try to stretch it so it comes back to the constitution and the amendments. Our government was created to protect our rights, not slowly take them away, because it annoys a few people don’t like it. This is ridiculous.http://www.oregonlive.com/newsflash/index.ssf/story/maine-man-can-whistle-but-he-must/e80365dd6aa94026810186becdc38a09
